What is a Bankruptcy Search?
Companies may conduct a bankruptcy search to reveal whether an individual or business has filed for bankruptcy. This search is often conducted to assess the financial stability and creditworthiness of a third party before entering into a financial agreement or transaction. It’s a way to evaluate financial risk.
There are a three types of bankruptcies:
- Chapter 7: Liquidation bankruptcy. A debtor's assets are sold to pay off creditors.
- Chapter 11: Reorganization bankruptcy. This is usually for businesses, allowing them to restructure their debts and continue operations.
- Chapter 13: Wage earner's plan. Individuals with regular income create a plan to repay all or part of their debts.
A bankruptcy search will help you assess the financial history and risk associated with an individual or business, so you can make an informed decision before entering into an agreement, partnership, or transaction.
